In view of such extension of the benefit of pre-arrest bail on 24.08.2023, it prima facie appears that the basis of issuance of NBWAs by the Orders, dated 17.07.2023 & dated 01.08.2023, by the learned Chief Judicial Magistrate, Dimapur had become redundant. With the extension of the benefit of pre-arrest bail for a further period of 15 [fifteen] days from 16.11.2023 by the Order dated 16.11.2023 passed in I.A. [Crl.] 20/2023, it prima facie appears that the issuance of NBWA by Order dated 09.09.2023 has to be considered to be impliedly kept in abeyance. Be that as it may, as the petitioner has undertaken to comply with the condition made in the Order dated 16.11.2023, passed in I.A.[Crl.] no. 20/2023, by appearing before the Investigating Officer of the case and thereafter, by appearing before the Court of learned Chief Judicial Magistrate, Dimapur in order to file application seeking recall of the NBWAs, this Court is of the considered view that instead of keeping this criminal petition, the interest will be better subserved if the NBWAs issued vide Order dated 17.07.2023, Order dated 01.08.2023 & Order dated 09.09.2023 are kept in abeyance for a period of 6 [six] weeks from today. It is ordered accordingly. As a corollary, the NBWAs issued vide those orders are also kept in abeyance for the said period of 6 [six] weeks.
