Heard the learned counsel for the parties.

This present application is filed under Section 438 Sub Section 2 read with Section 482 of the Code of Criminal Procedure, 1973 for the cancellation of the anticipatory bail granted in connection with the AB Case No. 3705/2022 arising out of Krishnai P.S. Case No. 102/2022 registered under Sections 120(B)/326/307 of IPC.

The learned counsel for the petitioner submits that as the charge sheet has already been filed, he will not press the present application, however, he seeks a liberty that in the event, the accused persons try to hamper or tamper with the evidence, he may be granted a liberty to approach the learned trial Court.

Accordingly, the prayer for withdrawal is allowed.

¶46

It is needless to say that, an aggrieved person shall always be at liberty seeking cancellation of bail in the event, the accused person violates the condition of bail.
