When the matter was listed on 10.05.2023, this court requested Mr. KK Parasar, learned Additional Public Prosecutor to have instruction from the Officer-in-Charge of Mahabhairab Out Post, Sonitpur as it is alleged in the present contempt petition that even after receipt of an order dated 07.02.2023 passed in Crl. Pet. 106/2023 debarring the investigating authority to further proceed with the investigation in connection with Tezpur P.S. Case No. 1290/2022 corresponding to GR case No. 2440/2022, the investigating officer continued with the investigation, written letter to the Branch Manager, Punjab National Bank, Sonitpur, Tezpur and to the Tezpur Municipal Board.
Mr. Parasar after having instruction from the concerned police officer i.e. Ms. Jinu Hazarika has submitted that due to inadvertence though she has received the copy on 15.02.2023 issued the letters. However, immediately after getting the information, the said letter to the Branch Manager of the Bank concerned has been withdrawn and she has expressed her unconditional apology for this inadvertent mistake. It is also submitted by Mr. Parasar that she has also undertaken that she will not proceed any further with the investigation in term of the order dated 07.02.2023 passed in Crl. Pet. No. 106/2023 and the communication issued to the Tezpur Municipal Board has also been withdrawn.
In that view of the matter, this court has accepted such unconditional apology and accordingly the contempt petition is closed.
