Mahidul Islam Khan and Anr. Vs the State of Assam

This is an application under Section 439 of the CrPC, praying for bail by the petitioners, namely, 1. Mahidul Islam Khan and Shahidul Islam, who are in detention in respect of Khetri P.S. Case No. 189/2022 under Section 457/380 IPC.

It is alleged in the FIR that 33 quintals of Erica nuts were stolen from the godown of the informant. During investigation it was discovered that the petitioners had purchased the stolen Erica nuts.

It appears that Mahidul Islam Khan has a license for doing business of Erica nuts and the other petitioner, Shahidul Islam is his brother.

The petitioners have already spent 41 days in custody.

Considering the aforesaid facts, the bail prayer of the petitioners is allowed. Accordingly, the petitioners named above in connection with the aforesaid case, shall be released on bail of Rs. 25,000/- each with one suitable surety each to the satisfaction of the learned CJM, Kamrup (M), Guwahati.
