Heard Mr. S Dey, learned counsel for the petitioner and Mr. M P Goswami, learned Additional Public Prosecutor, Assam for the State.

This application under Section 439 Cr.P.C. has been filed by the petitioner, namely, Sri Indranil Roy , seeking bail in connection with Panbazar P.S. Case No. 133/2023 registered under Sections 420/406 IPC corresponding to G.R. No. 3673/2023, wherein he was arrested on 24.05.2023 and since then he is in custody.

It is submitted by the petitioner that he is only a Medical Representative of Lift Life Biotech Private Limited and payments were made to the said company by cheques and as such, he has no role to play regarding non-supply of medicines though in the FIR pertaining to said Panbazar P.S. Case No. 133/2023, it has been alleged that he cheated the said pharmaceutical establishment.

Mr. S Dey, learned counsel on behalf of the petitioner also submitted that at best the pharmaceutical establishments may file civil suit against the Lift Life Biotech Private Limited to whom they have given their cheques.

Case diary reveals that the petitioner approached numbers of pharmaceutical establishments in and around Guwahati by assuring them to provide medicines for sale, took money of Rs.5,00,000/from M/s. L.B. Medi Services Private Limited and sold the medicines on behalf of Lift Live Biotech Private Limited through M/s. L.B. Medi Service Private Limited and thereby took away the entire money in the account of Lift Life Biotech Private Limited. It is seen that the investigation is in the initial stage and the petitioner has cheated numbers of such pharmaceutical companies assuring them to supply medicines.

Considering the materials available in the case diary against the petitioner with regard to his involvement in the alleged crime, the Court is of the view that it is not a fit case to grant bail to the petitioner, namely, Sri Indranil Roy in said Panbazar P.S. Case No. 133/2023.

Accordingly, this bail application of the petitioner, Sri Indranil Roy, in said Panbazar P.S. Case No. 133/2023 stands rejected.
