Heard Mr. A. Baruah, learned counsel for the petitioners.
Also heard Mr. K. K. Das, learned Additional Public Prosecutor for the State who submits that the case diary which was called for has arrived and on perusal of the case diary it appears that there is no incriminating materials against the present three petitioners.
Accordingly, on the basis of submissions made by the learned counsel for both sides as well as on perusal of the materials before the Court including the case diary, the interim anticipatory bail granted to the the petitioners, namely, 1. Raihan Uddin, 2. Md. Jabed Ahmed and 3. Emdadur Rahman is hereby made absolute with the condition nos. 2, 3 and 4 attached to the said order remaining intact.
With the above observations, this anticipatory bail application is hereby made absolute.
