Heard Mr. A. Sharma, learned counsel for the petitioner and Mr. A. Chakraborty, learned Junior Government Advocate for the respondents.

The father of the petitioner Bhola Borah, who was working in the 9^th APBN Barhampur, died in harness on 28.05.2009 and on his death, the petitioner submitted an application for compassionate appointment on 22.09.2011. The limited grievance raised is that the said application had not been placed before the DLC concerned for its consideration.

Considering the limited grievance raised, we direct the Superintendent of Police, Nagaon to place the application of the petitioner for compassionate appointment made on 22.09.2011 before the next available DLC of Nagaon District and the DLC may pass any reasoned order thereon as per law. We further provide that in the event the application was earlier placed before the DLC, the petitioner be informed about the order that may have been passed and in such event, there would be no further requirement to place it before the DLC again.
