Corporation of India (FCI) service records and several other documents, the date of birth is shown to be 25.02.1953 and the date of superannuation of the petitioner would be 28.02.2013. For the purpose of correction of the date of birth, the petitioner had approached this Court by filing the writ petition which was registered and numbered as WP(C) 1043/2009. It appears that there are several orders passed from time to time to extend the service of the petitioner and ultimately by order dated 21.10.2014, the Court disposed of the writ petition by permitting the petitioner to approach the respondent Corporation with his grievances and it was provided that it would be open to the petitioner to approach the Civil Court for resolution of the dispute in the event if he is still aggrieved by the decision of the respondent Corporation and further liberty was also granted to the petitioner to approach the respondent Corporation by filing an appropriate appeal/ representation highlighting his grievances. Accordingly, the petitioner appears to have superannuated on 31.10.2014 which finds affirmation from the stand taken by the respondents in para-6 and 7 of their affidavit-in-opposition, wherein it has been specifically stated that the petitioner was allowed to work from 28.02.2014 (sic. should be 28.02.2013) to 31.10.2014 as per the direction of the Court vide orders passed in the hereinbefore referred WP(C) 1043/2009.
