Heard Mr. J. Islam learned counsel for the petitioners. Also heard Ms. S. Sarma, learned State counsel and Mr. P. Nayak, learned Standing Counsel, GMC.
The case of the writ petitioners is that they earned their livelihood by driving Auto Rickshaws and they were aggrieved by uprooting of their Auto Stand from SRCB road adjacent to Fancy Bazar police station.
The learned counsel for the petitioners has submitted that in the meantime, the corporation has clearly demarcated the parking area of the petitioners’ auto stand ie SRCB road and in view of such demarcation, the petitioners are having no surviving cause of action as on date. Accordingly this writ petition is closed having no surviving cause of action.
However, liberty is granted if they are aggrieved with any action of the respondent, they may approach this court again, if it is permitted under the law.
