Heard Mr. P. Daimary, learned counsel for the petitioners. Also heard Mr. P.N. Sarma, learned Standing Counsel, Elementary Education Department for Respondents No.1 and 3; Mr. R. Borpujari, learned Standing Counsel, Finance Department for Respondent No.2; and Mr. P. Choudhury, leaned counsel for Respondents No.4 to 7.

Petitioners are retired Headmasters and Assistant Teachers of various L.P. Schools and High Madrassa in the District of Kokrajhar, who were earlier deputed to DPEP and SSA as RT and CRCC.

By this writ petition, the petitioners pray for a direction to the respondents to pay the Earned Leave encashment benefits to the petitioners for a maximum period of 300 days by calculating 30 days per year after deducting the leave encashment benefits already paid to them.

After hearing the learned counsel for the petitioners and on consideration of the materials on record, this Court directs the petitioners to file separate representations before the Respondent No.4/Mission Director SSA, Assam, and also to the Respondent No.5/ the Director of Education, BTC, Kokrajhar, BTR, Assam within a period of one month from today. Thereafter, the Respondents No.4 and 5, on receipt of the separate

representations filed by the petitioners, shall consider the same and pass a reasoned order to the respective representations of the petitioners within a period of two months from the date of receipt of the said representations.
