Accepting the said position, Mr. Chakraborty, learned counsel for the petitioner submits that this writ petition has become infructuous.
In view of the above, this writ petition stands disposed of as infructuous by granting leave to the writ petitioner to pursue appropriate remedy, as may be available under the law, against the defaulter.
