Heard Mr. F.Z. Mazumdar, learned counsel for the writ petitioner. Also heard Mr. D. Gogoi, learned Standing Counsel, APDCL, who submits on instruction obtained as per order dated 29/07/2022 that the domestic connection to the petitioner’s premises has been disrupted due to some mischief committed by him and unless the provisional assessment bills are paid by the petitioner, the same cannot be rectified by the respondents.
Mr. Mazumdar, learned counsel for the petitioner, on the other hand, has denied and disputed the allegation brought against his client. However, since there are disputed question of facts involved in this proceeding, the learned counsel for the petitioner seeks leave of this Court to withdraw the writ petition with liberty to prefer statutory appeal against the provisional assessment bills served upon the writ petitioner.
In view of the submission made by Mr. Mazumdar, learned counsel for the petitioner, this writ petition stands disposed of on withdrawal, with liberty as prayed for.
