Heard Mr. S.S.S. Rahman, learned counsel for the petitioner. Also heard Ms. M.D. Borah, learned Standing Counsel, Transport Department.

In this petition, the petitioner has challenged the vires of the Rule 11(6)(i) of the Assam Transport Service Rules, 2003 as it does not provide adequate promotional avenues to the Enforcement Inspector.

In this regard, Ms. Borah, learned Standing Counsel, Transport Department has submitted that the petitioner, however, has been given financial up-gradation under Assured Career Progression Scheme (ACPS) in view of the lack of promotional avenues.

We are of the view that if promotional avenues are not available and the benefits under Assured Career Progression Scheme (ACPS) are given, they would mitigate the expectation for higher promotion.

A copy of the order dated 04.06.2022 passed by the Transport Department, Government of Assam whereby the petitioner has been given the financial up-gradation has been placed on record.

Under the circumstances and in view of the financial up-gradation given to the petitioner, the learned counsel for the petitioner submits that he would not like to press this petition.

In view of the submission made above, we close this petition as not pressed.
