Being aggrieved, the petitioner made a complaint before the Director of Elementary Education on 25th July, 2019, praying for provincialisation of his service. Accordingly, the Deputy Director, Elementary Education, Assam, by the communication dated 26th July, 2019, addressed to the District Elementary Education Officer, Dhubri, requested to verify the matter on the basis of the complaint made by the petitioner and to furnish a report as per the provisions of the Act of 2017. Thereafter, the Block Elementary Education Officer, Dhubri had a field verification and a report was submitted with regard to the petitioner’s school wherein the name of petitioner figures at Serial No.3 and his date of joining is shown as 2.12.2006; and the name of Respondent No.7 figures at Serial No.5 and his date of joining is shown as 22.1.1995 as a Hindi Teacher. Without considering the report filed by the Block Elementary Education Officer, Dhubri, the Director of Elementary Education Officer, Assam, issued an order dated 5.2.2021, provincialising the service of Respondent No.5 as a Tutor. Being aggrieved, the petitioner is before this Court by way of the present writ petition.
