Heard Mr. A. Sarma, learned counsel for the petitioner. Also heard Mr. J.K. Parajuli, learned junior Government Advocate for the respondents No. 1, 4 and 5 respectively the Chief Secretary, the Commissioner and Secreary in the General Administration Department and the Deputy Commissioner, Sivasagar and Mr. N.D. Sarma, learned counsel for the respondents No.2, 3 and 6 being the authorities under the P &RD department.

The father of the petitioner who was working as a Tax Collector in the Office of the Hanchara Gaon Panchayat in Sivasagar, died in harness on 04.01.2015 and on his death, the petitioner submitted an application for compassionate appointment. The said application was placed before the DLC, Sivasagar district in its meeting dated 27.04.2015 and the petitioner was

recommended against the vacancy evaluated for the year 2013-2014 for the post of Tax Collector. The grievance raised is that the said application has not been placed before the SLC.

Considering the grievance raised, we direct the P&RD department, Government of Assam to place the recommendation of the DLC dated 27.04.2015 made in favour of the petitioner before the next available SLC.

The SLC may take its own decision as may be admissible under the law. In the event, the recommendation was earlier placed before the SLC, the result thereof be informed to the petitioner and in such event, no further requirement to place it again before the SLC.

Writ petition stands disposed of as indicated above.
