5.3 Charge No. 03, 04 and 05. The charge No 03, 04 and 05 are taken up together for convenience was, "3. That as per terms and conditions No 5.2.1 (i) of sanction letter No. AFC/HO/APP/LP-2655/2012-13/120 Dated 12/04/13 he has for mortgage of land measuring 1 Katha covered by Dag No. 66 (Old)/ 633 (New) / 347 (New), Patta No. 68 (Old)/231(New)/209(New) of Vill- Bagharbari, Mauza - Beltola, Kamrup (M), owned by Mrs. Wahida Begum and in this connection he has obtained a gift deed with other allied documents as a security against loan and created equitable mortgage by the way of deposition of the title deed. However, he has not verified the gift deed. Wherein the deed number in the deed found Photostat, without round seal on each page of the deed and at the last page of the deed there is no seal, which does not prove the originality of the gift deed. Therefore, the genuinity of the gift deed submitted to the corporation seems to be doubtful. Thus, he has not verified the document with due diligence and it is a serious lapse in his part", "4. That as per terms and conditions No 5.2.1 (ii), (iii) & (IV) of the sanction letter No.AFC/HO/APP/LP-2655/2012-13/120 Dated 12/04/13, the loan was sanctioned to Ms Aastha Packaging, Dholabari, PubBansar, Kamrup (Rural) Amounting Rs. 250.00 Lakhs against among other security the security of the Assam type building (139.34 Sqm) & One three storied RCC Building (476.21 Sqm), Boundary Wall, Bore well etc. standing thereon but while obtaining mortgage of land, he has not included these as a security of the loan and violated the terms and conditions of the sanction" and "5. That the mortgaged land is 2.68 acre i.e. 1 Katha (as detailed at para 3 above), but he has taken the sketch map for 9.68 acre, hence the sketch map does not specify the mortgage area of the land, thus he has also not done the demarcation of the mortgaged land, thereby he has violated the other conditions 9. (XIV) and additional condition No.7 of sanction letter" which were explained to the C.O. The allegation No.3 is denied by Sri Hari Prasad Bora. He stated that he verified the Gift Deed with the Sub Registrar Office about the genuineness of the same and obtained confirmation that the deed was original. But to support his statement there is no statement or any written documentary proof supporting his statement. His visit to the sub registrar office is also not supported by any proof. He has not reported the matter to his higher authority also.
