Heard Ms. U. Hazarika, learned counsel for the petitioner, Ms. P. R. Mahanta, learned counsel for the respondent No. 1 Revenue Department of the Government of Assam. Also heard Ms. M. Barman, learned Junior Government Advocate for the respondents No. 2, 4, 5 and 6 and Mr. S. Bora, learned counsel for the respondent No. 3, BTC.

By this writ petition, the petitioner seeks for a demarcation in respect of land measuring 3B-4K-12L of Dag No. 258 of periodic Patta No. 89 of village No. 2 Chatianguri (Kadamtola) under Bijni Revenue Circle in the district of Chirang,

Ms. M Barman, learned Junior Government Advocate submits that the procedure to be now adopted by the Circle Officer to undertake the process of demarcation would have to be under the Assam Right to Public Services Act, 2012 (in short Act of 2012) and the procedures provided thereunder.

In view of such submission, we direct the Circle Officer, Bijni Revenue Circle to entertain the application of the petitioner for demarcation which was filed on 14.09.2021 and pass a reasoned order thereon and in doing so, the complete procedure provided under the Act of 2012 be followed. For the purpose, if necessary, notices may be also issued to any other affected persons, who according to the Circle Officer require a hearing to be given under the law. The writ petition is disposed of as indicated above.
