Heard Mr. B.D. Konwar, learned Senior Counsel assisted by Ms. D. Brahma, learned counsel for the petitioner . Also heard Mr. A. Chaliha, learned counsel for the respondent nos.1 – 4, Mr. B. Deka, learned counsel for the respondent no.5 and Mr. J. Patowary, learned counsel for the respondent no.6.

The provisional result of the faculty selection has been submitted by Mr. B. Deka, learned counsel for the respondent no.5 and seen by this Court. It is seen that the petitioner has not been selected for the post of Additional Professor, Head of Department of Forensic Medicine & Toxicology in All India Institute of Medical Sciences (AIIMS), Guwahati.

In view of the fact that the petitioner has not been selected for the said post, this Court if the view that there is no requirement of going further into the merits of the case, as the same would only be for academic interest.

Accordingly the writ petition stands closed, with permission being given to the respondent no.5 to publish the result of the selection process for the post of Additional Professor, Head of Department of Forensic Medicine & Toxicology, AIIMS, Guwahati. The closure of the writ petition will however not prejudice the right of the petitioner to challenge a similar type of issue in the future, as the case has not been decided on merit.

The writ petition is accordingly disposed of.
