opposition, wherein objection is raised in respect of the claim for 100% solatium with the 12% interest on the ground that under the Balipara/Tirap/Saida Frontier Tract Jhum Land Regulation, 1947 (in short “the Regulation of 1947”), there is no provision of payment of solatium and interest. It is also the stand of the respondent no.4 that as per the clarification issued by the Govt. of Arunachal Pradesh on 05.08.2016, the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (in short “the Act of 2013”) would not cover the land acquisitioned under the Regulation of 1947. Reliance is also made to a letter dated 16.09.2016 by the respondent no.2 wherein it was clarified that no solatium and interest were added to compensation assessed under the Regulation of 1947. Accordingly, the provisions of the Act of 2013, as provided under section 24 thereof would not be applicable in this case. It is also projected that under section 17 of the Regulation of 1947, provision for appeal has been provided and that the petitioners have not availed the said remedy. Hence, it is submitted that in the absence of any appeal, the present writ petition would not be maintainable.
