Heard Mr. Alhajj I Uddin, learned counsel for the petitioner, who submits that pursuant to an Advertisement dated 09.10.2019, for appointment to the post of Anganwadi Worker against the Dighaliati Atigaon Anganwadi Centre, the petitioner and the private respondent took part in the selection process. The private respondent was thereafter appointed to the post of Anganwadi Worker.

Being aggrieved, the petitioner filed WP(C) No. 1341/2020 stating that the private respondent could not have been appointed as Anganwadi Worker, as she was not a permanent resident of the surveyed area of the concerned Anganwadi Centre.

The petitioner’s counsel submits that to justify the appointment of the private respondent, the State respondents have illegally entered the name of the private respondent in the survey register of the said Anganwadi Centre. He accordingly prays that as the dispute involves disputed questions of fact, the respondent No. 2 may be directed to take a decision, with regard to the grievance of the petitioner.

Mr. J.K. Goswami, learned counsel for all the State respondents submits that he has got no objection to the prayer made by the petitioner’s counsel.

In view of the consent of the parties, these 2 (two) writ petitions are being disposed of, with a direction to the respondent No 2, to take a decision on the grievance of the petitioner that the private respondent is not a resident of the

surveyed area of the said Anganwadi Centre and that the name of the private respondent has been illegally entered by the State respondents in the survey register of the Anganwadi Centre.

The entire exercise should be concluded within a period of 2 months from the date of receipt of a certified copy of this order, to be furnished by the petitioner.
