Heard Mr. S.S. Roy, learned counsel for the appellant.
Mr. S.S. Roy very fairly submits before this Court that a similar matter being WA No.96/2021 (Hindustan Petroleum Corporation Ltd. & 3 Ors vs. Mira Rani Sarkar) had been dismissed by this Court on 24.09.2021, whereby it was held that if there was no wilful default or concealment on the part of the respondent/writ petitioner regarding submission of the lease deed, the security amount deposited so cannot be withheld. Accordingly, Mr. Roy submits that in view of the order passed by this Court in WA No.96/2021 on 24.09.2021, the appellant would not like to press this appeal.
In view of the above submission made, the preset appeal stands closed as not pressed.
