The brief facts of the case are that in the year 1996 an advertisement was given for filling up 7500 posts of Lower Primary and Upper Primary throughout Assam and 67 and 16 posts were advertised for L.P. and U.P. school respectively in No.27 Bilasipara East Constituency for which the appellants/writ petitioners were the candidates. According to the appellants/writ petitioners, they had applied for the said posts. They were qualified and their names also figured among the selected candidates but as they were not given appointment, they were constrained to file writ petition, being WP(C) 6634/2004 before this Court and this Court vide order dated 18.12.2008 directed the State authorities, more particularly the Commissioner & Secretary to the Government of Assam, Education (E) Department, to take an appropriate decision vis-a-vis the select list dated 13.03.2001 and appointments, if any, therefrom. Subsequently, a speaking order was passed on 20.12.2010 by the Commissioner & Secretary to the Government of Assam, Education (E) Department stating that there were no vacancy. This order was challenged by the petitioners in WP(C) 4785/2021 and this Court by the order impugned herein closed this writ petition.
