The case of the petitioner before this Court in brief is that the marriage between the petitioner and the respondent was solemnized on 29.06.2018 at Tinsukia Town, Marwari Panchayati Dharmshala located at A.T. Road as per the wishes of the respondent. In the instant petition, there have been various allegations made to the effect that the petitioner was subjected to various mental tortures by the mother-in-law by treating her as a maid servant. It has been further alleged that although the respondent was aware of the fact of such ill treatment and inhuman behaviour being committed by his mother, he did not come forward to her rescue which had resulted in adverse impact on the health of the petitioner. It is stated that the petitioner on 10.08.2018 came to her parental house at Sivasagar and since then she has been living with her parents. However, on 07.12.2018, the respondent went to the parental house of the petitioner in order to bring her back to the matrimonial home where he had raised hue and cry and threatened the entire family members to face dire consequences if the petitioner is not sent back along with him. It is stated that the respondent filed a petition for restitution of conjugal rights before the Court of the District Judge, Tinsukia which was withdrawn on 05.09.2020 and thereafter the respondent filed a petition under Section 13 (1) (i a) and 13 (1) (i b) of the Hindu Marriage Act, 1955 praying for a decree of divorce.
