Heard Mr. A. K. Bhuyan, learned counsel representing the applicant as well as Mr. B. Sarma, learned Additional Public Prosecutor, Assam.

This is an application filed under Section 439 CrPC by the petitioners, namely, (i) Umesh Chand Jhoshi; (ii) Pawan Kumar; and (iii) Abhishek Sharma seeking release on bail in connection with Guwahati GRPS Case No. 20/2022 under Sections 120(B)/417/420/379/34 of the IPC.

The allegation against the petitioners is that on 15.02.2022 they were found in possession of Rs.1,48,30,600/- and they could not produce any document in support of the said amount.

The Case Diary reveals that the petitioners are the employees of a transport company under the name and style of ‘Super All India Roadways’, which involves in transportation of goods to Arunachal Pradesh, Manipur etc. from Sikandrabad.

The money was given to the petitioners by the company for distribution amongst other employees. On one occasion, the seized money was given back to its owner by the court below.

Now, this court is of the opinion that at this stage there is nothing incriminating against these petitioners and, therefore, they do not deserve further detention in custody for any further period of time. Hence, the prayer for bail is allowed.

Accordingly, the petitioners Umesh Chand Jhoshi, Pawan Kumar and Abhishek Sharma be released on bail in connection with Guwahati GRPS Case No. 20/2022 under Sections 120(B)/417/420/379/34 of the IPC on

furnishing bail bond of Rs.25,000/- each with one surety each to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (M), Guwahati.
