reading of the statements of the witnesses including that of relatives of the accusedpetitioner and the Monowar Hussain [since deceased], it goes to indicate that Monowar Hussain [since deceased] had started a factory for manufacturing plastic bottles etc. in his own house and he used to sell the same at different places. At around 05-00 p.m. on 03.10.2021, all the members of the family had gone to attend a marriage ceremony and they returned to their house at 06-30 p.m. Thereafter, Monowar Hussain [since deceased] informing that he had received a business related call from Mobile no. 9375264372, went out of his house to meet someone at a place near B.H. College on the National Highway. When the wife of Monowar Hussain [since deceased] called him at around 07-50 p.m., Monowar Hussain [since deceased] received the call. But thereafter, the mobile phone of Monowar Hussain [since deceased] was found switched off until 11-30 p.m. At around 11-30 p.m., the brother-in-law of Monowar Hussain [since deceased] made a call to the mobile phone of Monowar Hussain [since deceased] and at that point of time, some unknown person received the phone and informed that the car of Monowar Hussain [since deceased] was lying inside a pond. Having received the information, all the family members of the deceased went to the place of occurrence and found that in the meantime, the dead body of Monowar Hussain [since deceased] was taken out from inside the water of the pond by some persons and the body of Monowar Hussain [since deceased] was kept on the ground by the roadside. Thereafter, the police came to the place of occurrence and took out the vehicle, belonging to the deceased, from inside the water of the pond by a crane.
