The Court proceedings have been conducted through Video-Conference due to Covid19 pandemic.
This is an application made under Section 439 Cr.P.C. , seeking bail by the accused-petitioner, namely, Ramjan Ali , in connection with Bongaigaon Police Station Case No. 996 of 2021 , registered under Section 22(a) of the NDPS Act . Heard Mr. R. Islam, learned counsel appearing on behalf of the petitioner and Ms. S.H. Bora, learned Additional Public Prosecutor representing the State.

It has been submitted by Ms. Bora, learned Additional Public Prosecutor that in the instant case, charge-sheet vide CS No. 03/2022, dated 23-01-2022, has already been laid by the Investigating Police Officer.
That being so, if so advised, the petitioner may approach the learned Court below with an appropriate application for bail and on his appearance, if such an application is made, the learned Court below shall consider and dispose of the same on its own merit taking into account all relevant factors. The bail application stands disposed of accordingly.
