Heard Mr. T. Tapak, learned counsel for the accused and also heard Mr. G. Tado, learned Addl. PP for the State.

This bail application under Section 439 Cr.P.C. is preferred by Shri Minot Jomoh praying for granting bail to the accused Smti. Yayi

Lendo Jomoh who has been languishing in jail hazot in connection with Itanagar P.S. Case No. 26/2022 under Section 489 (A) (B) (C) (D) (E)/120(B)/34 IPC since 09.01.2022.

The allegation against the accused is that acting on a tip off Inspector Phassang Simi of Itanagar Police Station conducted raid in the house of Smti. Yayi Lendo Jomoh of Abotani Colony on 18.01.2022, at about 3.30 PM. On searching the house, few grams of suspected heroin drugs were recovered from her house. Thereafter, search was also conducted in the rented house of Smti. Yayi Lendo Jomoh where one of her nephew Sh. Hogli Ori was staying and during search, one printer with some 500 notes of counterfeit currency lying on the ground and some notes were printed from the said printer were recovered and seized.

Mr. Tapak, learned counsel for the accused submits that nothing was recovered from the possession of the accused and that she is innocent and she is languishing behind the bar since 09.01.2022 and besides, she is a woman and there is no chance of absconding and therefore, Mr. Tapak, learned counsel for the accused contended to allow her to go on bail.

On the other hand, Mr. G. Tado, learned Addl. PP, producing the Case Diary before this Court submits that the printer and counterfeit currency notes were recovered from her possession and as such, opposed the prayer for bail.

However, after going through the Case Diary, I find that the

seized printer and counterfeit currency were not recovered from the possession of the accused Smti. Yayi Lendo Jomoh. She is a woman and she is languishing in the Jail hazot since 09.01.2022.

It also appears from the Case Diary that the investigation has already been completed and Charge-Sheet has been submitted. Now, trial will start and the accused has to prepare her defence.

Considering the submission of learned Advocates of both the sides and also considering the nature and gravity of the offence and further the progress of the investigation as well as the materials so far collected in the Case Diary in support of the allegation made against the accused, it seems that further detention of the accused, namely, Smti. Yayi Lendo Jomoh is not required for the purpose of investigation.

Accordingly, it is provided that the accused, aforementioned, be enlarged on bail on her executing a bond of Rs.30,000/- with one surety of like amount to the satisfaction of the learned Special Judge (NDPS), Yupia.

Case Diary be returned, forthwith.
