The brief facts of the case are that on 28.10.2020, the informant one Raj Kishore Kerketta, Regional Manager, Central Bank of India, Regional Office, Jorhat lodged an F.I.R. to the effect that the F.I.R. mentioned 6 accused persons approached the Talap Branch of Central Bank of India for financial assistance and credit facilities for establishment of Poultry Units. Proposals to the extent of Rs.8 lakhs with project report for each were forwarded by the Office of the District Animal Husbandry and Veterinary Officer, Tinsukia under Poultry Venture Fund (subsidy) assisted by “Department of Animal Husbandry, Dairying and Fisheries, Ministry of Agriculture, Government of India” through NABARD subsidy. The then Branch Manager, that is, the present petitioner, considering the viability of the proposals, sanctioned the agriculture term loans to the borrowers. But, later on, it was found that due to failure of repayment of EMI/principal and interest in one of the accounts, namely Mr. Shivnath Sah, the account was marked as NPA by external auditors in 2018. In other loan accounts, it was shown as ‘Nil’ payments since sanction. When the Branch officials tried to contact said Shivnath Sah and other persons, they were not found in the addresses given by them to the bank. It was found that the Voter IDs submitted in the bank by those persons were fake. During departmental investigation, it was found that the FIR named accused persons, by submitting fake/fabricated KYC documents along with forged Govt. department documents and project reports, took loans amounting to Rs.52,54,277/- and made the Bank to suffer huge loss.
