From perusal of the impugned order dated 20.06.2019, it is seen that the Estate Officer, East District, Pasighat directed the petitioner to dismantle and remove the illegally erected structure within a period of 20 days in exercise of the powers conferred under Section 5 of the Arunachal Pradesh Public Gremmies (Eviction of Unauthorized Occupant) Act, 2003 and failing which, appropriate action against him was contemplated. The petitioner thereafter filed an Appeal i.e., Appeal Case No. 6/2019 before the Deputy Commissioner, East Siang District at Pasighat against the order of the Estate Officer. However, the Deputy Commissioner in the impugned order dated 27.01.2021, in view of the withdrawal of the private respondents from the appeal took a view that the appeal had lost its force due to the withdrawal made by the private respondents. It may however be seen that even after the disposal of the appeal in such a manner, the impugned order dated 20.06.2019 still remains and that the petitioner is required to vacate the land by dismantling the structures that he had erected.
