Aggrieved by the repetitive advertisement by the respondent authorities to fill up the post of Professor in the Department of Psychology and not considering the candidature of the petitioner, the petitioner has filed this writ petition under Article 226 of the Constitution of India.

At the outset, the learned standing counsel for the respondents has referred to the statement made in an affidavit filed by the respondent nos.1 and 2 on 10.09.2020 to project the advertisement dated 29.02.2020, to fill up the post of Professor in the Department of Psychology, which was issued during the pendency of the writ petition had been withdrawn on 27.06.2020 and that the stand of the respondent authorities is that the petitioner would be called for interview in pursuance to the earlier advertisement dated 04.12.2015. It is submitted that in view of the stay order passed by this Court against holding the selection process, the respondent authorities have not been able to conduct the interview.

In view of the said stand, the learned counsel for the petitioner has fairly submitted that as the respondent authorities have assured by their affidavit that the petitioner would be called for the interview without requiring him to submit a fresh application, he submits that the writ petition be disposed of accordingly.

As the learned counsel for both the sides are ad idem on the point that the interview would be held to fill up the post of Professor in the Department of Psychology pursuance to the earlier advertisement dated 04.12.2015 without requiring the petitioner to submit a fresh application, the writ petition stands

disposed of in the aforesaid terms.

The order of stay dated 05.02.2016 stands vacated.

The Court also hopes and trust that the process of interview shall be initiated by the respondent authorities within a period of 2 (two) months from the date of this order.

It would be open to the learned standing counsel for the respondent authorities to download a copy of this order for onward transmission to the respondent authorities. The petitioner shall also serve a certified copy of this order to the Registrar of the Gauhati University (respondent no.2).
