No one appears for the petitioners while Mr. R. Dhar, learned Standing Counsel appears for the Handloom & Textile Department.

The petitioners are aggrieved at not being selected to the 6 vacant posts of Master Weaver in pursuance to an Advertisement dated 23.07.2019. Further, the petitioners have taken a stand that a similar matter, i.e, WP(C) No. 1281/2020 is pending before this Court.

Mr. R. Dhar, learned Standing Counsel for Handloom & Textile Department has produced a copy of the Order dated 27.07.2020 passed in WP(C) No. 1281/2020, which shows that the said writ petition has been dismissed for non-prosecution. Further, I.A(Civil) No. 1285/2020, which has been filed for restoration of WP(C) No. 1281/2020 had been withdrawn on

15.03.2021, without any prayer for re-filing of a restoration application. The petitioners herein have however not made any mention of the fact that WP(C) No. 1281/2020 had been dismissed for non-prosecution or that I.A(Civil) No. 1285/2020 had been withdrawn, though the present writ petition was filed on 12.11.2021.

Mr. R. Dhar, learned counsel also submits that the 6 vacant posts are filled up in pursuance to the Advertisement dated 23.07.2019 vide order No. DHTE.44/2018/114 dated 14.09.2020 and the appointed persons have not been made parties to the writ petition.

The Order dated 14.09.2020, appointing 6 persons to the 6 vacant posts of Master Weaver in pursuance to the Advertisement dated 23.07.2019 is made a part of the record and marked as ‘Annexure-X’.

As no one appears on behalf of the petitioners, the writ petition is dismissed for non-prosecution.
