The appellant/writ petitioner no.1 before this Court is a Society registered under the Societies Registration Act, 1860 and the appellant/writ petitioner no.2 is the Governing Body of the Society. The appellants/writ petitioners were aggrieved by an enquiry instituted against them on allegations of running a racket where it had assured jobs to unemployed youth in the district of Lakhimpur and other nearby places which it did not fulfill. According to the appellants/writ petitioners, the Enquiry Officer who was appointed in the said enquiry showed high handedness in conduct of the enquiry and made search and seizures, without following the due process. They have also alleged that the members of appellants/writ petitioners Society were coerced and forced to sign certain papers. Hence, they filed a writ petition before this Court praying for setting aside the impugned enquiry report dated 03.03.2016 passed by the respondent no.1 and for direction to return the seized documents along with cash amount of Rs.4,69,530/-, I.P.O. amounting Rs.8,19,990/- and a compensation of Rs.1,90,63,500/-. The writ petition, however, did not find favour of the learned Single Judge as according to the learned Single Judge, the appellants/writ petitioners could not submit any document to show that there was any high handedness on the part of the Enquiry Officer of the seizure etc., was in violation of law.
