WP(C)No.6585/2013 was instituted, amongst others, by Habibur Rahman, son of Late Firoz Ali being the petitioner No.9, inter alia, seeking for a direction to the respondents to count the initial date of appointment which is 20.11.1999 to be the date of appointment and, accordingly, to give all the service benefits starting from the date of appointment as per Service Rules which was in force at the relevant period and further for a declaration that his earlier period of service from 20.11.1999 cannot be taken away by forcing them to agree with the date of appointment as per the new appointment order dated 22.12.2009. In other words, in the event, the relief sought for in the writ petition would be allowed, and the petitioners thereof would be entitled to certain financial benefits that may accrue pursuant to such declaration. The petitioner No.9, Habibur Rahman died on 13.08.2020 during the pendency of the writ petition. As in the event, the writ petition is allowed and there would be an entitlement of financial benefit, on his death, the right to sue and to be sued of the petitioner No.9 Habibur Rahman survives.
