Heard Ms. S.B. Choudhury, learned counsel for the applicant. Also heard Mr. S.M.T. Chistie, learned counsel for the respondents No.1, 2 and 3 being the authorities under the Secondary Education Department of the Govt. of Assam and Mr. S.R. Barua, learned counsel for the respondent No.5 Deputy Commissioner, Kamrup(R).

Considering the nature of the order proposed to be passed, notice is not required to be issued to the respondent No.4.

By this interlocutory application, the petitioner seeks to bring it to the notice of the Court that while WP(C) 2219/2021 was moved and the order dated 30.03.2021 was passed therein, the petitioner had inadvertently failed to bring it to the notice of the Court that two applications were filed by the applicant for compassionate appointment one on 26.08.2010 and the other on 07.05.2012. Although the subsequent application dated 07.05.2012 was taken note of, but because of such inadvertent mistake the earlier application of 26.08.2010 was not taken note of. Accepting the inadvertent mistake of the petitioner, this interlocutory application is disposed of by directing the DLC, Kamrup(Rural) to also take note that the petitioner had submitted an earlier application for compassionate appointment on 26.08.2010 over and above the other application dated 07.05.2012 and by taking note of the same to pass its

reasoned order while considering the application of the petitioner for compassionate appointment. In doing so, the DLC shall also verify from the record as to whether the prior application dated 26.08.2010 was infact submitted or not.
