Heard Mr. M. Sarma, learned counsel for the applicants. Also heard Mr. D. Gogoi, learned counsel for the Excise Department.

The applicants have prayed for a direction to be issued to the State respondents, to consider the case of the applicants for promotion, as and when the process is undertaken by the authorities, provided that they are within the zone of consideration for the same. He submits that the application may be allowed, without prejudice to the rights of the applicants with regard to their claim for seniority in the two writ petitions. He also submits that no prejudice will be caused to the private respondents if the present application is allowed.

Mr. D. Gogoi, learned counsel for the respondent nos.1 and 2 submits that he has got no objection if the application is allowed.

In view of the consent of the parties, the application is allowed. The respondents are accordingly directed to consider the case of the applicants for promotion as and when they come within the zone of consideration.

The said application is allowed without prejudice to the rights of the petitioners with regard to their claim for seniority in the 2 main writ petitions.

The interlocutory application is accordingly disposed of.
