Heard Mr. I. H. Saikia, learned counsel appearing for the applicants. Also

heard Mr. Pranjal Borthakur, learned Addl. Public Prosecutor, Assam, appearing for the State.

The applicants herein were arrested on 03.08.2021 in connection with

Mukalmua P.S. Case No.408/2021 registered under Sections 302/34 of the IPC and since then they are in custody.

Perused the Case Diary and the post-mortem report produced by the learned Addl. P.P. wherefrom, it appears that the victim had succumbed to a single head injury. It is also not clear as to what type of weapon, if any, was

used to assault the victim. Since this is a case of single injury, hence, taking note of the facts and circumstances of the case in its entirety as well as the length of detention of the applicants, I am of the view that the present is a fit case where the applicants deserve to be allowed to go on bail.

In view of the above, it is hereby provided that the applicants, viz., 1) Rinku Kaibarta, 2) Khargeswar Kaibarta, 3) Niren Kaibarta, be allowed to go on bail on furnishing bond of Rs.30,000/- each and one local surety each of like

amount to the satisfaction of the learned Chief Judicial Magistrate, Nalbari.

Bail Application stands disposed of accordingly.
