By this bail application under Section 438 CrPC, petitioners, namely, 1) Ibrahim Ali, 2) Manjuwara Begum and 3) Hasmat Ali, have sought for pre-arrest bail in the event of their arrest in connection with Panbazar PS Case No. 473/2021, under Sections 363/365/34 IPC.

Heard Mr A Ali, learned counsel for the petitioners and Mr B Sarma, learned Additional Public Prosecutor for the State of Assam. Also heard Mr M Khan, learned counsel for and on behalf of the informant.

Also perused the record and the Case Diary.

The present petitioners are the parents and paternal uncle of accused, Mehbob Alom, named in the FIR. The father of the victim girl, Nargis Sultana that Mehbob Alom has kidnapped his minor daughter with the present petitioners.

Case Diary reveals that only because the victim girl and the accused person has not yet been recovered, now, the Police Personnel are pursuing the present petitioners, to disclose the whereabouts of their son.

The accused, Mehbob Alam is a major person, who might have taken away the girl of the informant and for that purpose, the custodial detention of the accused petitioners, is not warranted. Accordingly, the interim bail order dated 17.09.2021, is hereby made absolute.

The Anticipatory Bail Application stands disposed of.
