(20) Bholanath Doley, (21) Nitamoni Doley, (22) Chitralekha Patir Doley, (23) Devajani Pegu Doley, (24) Napulion Pegu, (25) Ranjan Doley, (26) Mira Doley, (27) Anulata Doley, (28) Ratikanta Doley, (29) Nandina Morang, (30) Gopiranjan Doley and (31) Gobinda Doley have sought for pre-arrest bail in connection with the Dhakuakhana P.S. Case No.112/2021 (corresponding to G.R. Case No.167/2021), under Sections 143/325/324/294 /354/506 of the IPC.

Heard learned counsel for both sides and perused the record and case diary.

As it reflects that the entire incident took place at the time of election campaign and due to the political rivalry between two political parties i.e. the Ganasakti Party and the BJP, there was some hot altercation between the informant and others. From the statement of the victim woman, there is nothing in the case diary about the intention to outrage the modesty of her.

Considering all entirety of the matter, this Court is of the opinion that custodial interrogation of the accused/petitioners is not warranted. Accordingly the accused/petitioners named above are allowed to go on pre-arrest bail of Rs.10,000/- each, with one surety of like amount, in the event of their arrest by the arresting officer in connection with the Dhakuakhana P.S. Case No.112/2021, with further direction to the petitioners to appear before the I.O., within fifteen days from today and they will cooperate with investigation of the case.

The bail petition stands disposed of.
