Heard Mr. A. K. Hussain, learned counsel for the petitioner. Also heard Mr. J. Handique, learned Standing counsel, Revenue and DM (LR) Department for the respondent Nos. 1 and 2 and Mr. S. S. Roy, learned Government Advocate, Assam for the respondent Nos. 3 and 4.

Petitioner while serving as additional Mandal under the establishment of Deputy Commissioner, Dhubri during the time of settlement/re-settlement operation, by an order dated 25.02.2009 the Director of Land Records & Survey etc., Assam (Annexure-1), absorb petitioner as Mandal along with similar other additional Mandals of different districts of Assam and posted him under the establishment of Deputy Commissioner, Dibrugarh.

Petitioner is from Dhubri district and his family resides at Dhubri including his old aged mother of 90 years his wife and his family.

As there are vacancies of posts of Mandals in the district of Dhubri, petitioner filed a representation before the Director of Land Records & Survey etc., Assam on 25.09.2019 praying for his inter district transfer from Dibrugarh district to Dhubri district, which is still pending for disposal.

As the respondents in the Director of Land Records & Survey etc., Assam is sitting over the matter and did not consider his said representation, because of such inaction on the part of the said respondents, the petitioner has preferred this writ petition.

Considering the above and as agreed by the learned counsel for the parties, this writ petition is disposed of at the motion stage itself with a direction to the Director of Land Records & Survey etc., Assam to dispose of the representation of the petitioner dated 25.09.2019 with a reasoned order regarding his inter district transfer to the post of Lat Mandal from Dibrugarh district to Dhubri within a period of 60 (sixty) days from the date of receipt of certified copy of this order to be furnished by the petitioner along with the copy of this writ petition including the annexures appended thereto, obtaining necessary

acknowledgement in that regard from the respondent No.2, Director of Land Records & Survey etc., Assam.

Needless to say that the said respondent No.2 shall communicate the petitioner about the outcome of his said representation dated 25.09.2019.
