This application under Article 227 of the Constitution of India has been filed to assail the order dated 16.11.2019 passed by the learned Civil Judge No.2, Cachar, Silchar in T.S. No.49/2012.

At the outset, the learned counsel for the petitioner has referred to the case of Ramesh Chand Ardawatiya Vs. Anil Panjwani, AIR 2003 SC 2508 and it is submitted that the learned trial Court had rejected the written statement filed by the respondent No.1 herein (defendant No.4 in the suit) and therefore, as per the ratio laid down in the said cited case, the counterclaim cannot stand and, as such he prays for liberty to move the learned trial Court for an appropriate relief as against the maintainability of the counter-claim.

Liberty as prayed for is granted.

Accordingly, this revision stands closed on withdrawal with liberty as granted herein before.
