Heard Mr. B. Pathak, learned counsel for the applicant/petitioner, who submits that he has not been able to contact his client in spite of his best efforts in order to ascertain certain facts relating to the case.
Mr. Pathak submits that he has not been able to contact the client for the purpose of filing an affidavit as directed by this Court on 24.08.2020. Because of non-response from the

deponent, namely, Md. Sultan Ahmed, Mr. Pathak submits that he has no other alternative but to withdraw from the case. Mr. Pathak submits that he has already sent a notice to Md. Sultan Ahmed and also to the petitioner through the Jailer regarding his decision to withdraw from this case.
Under the aforesaid circumstances, as Mr. B. Pathak, learned counsel for the applicant/petitioner has withdrawn from the case, the bail application stands closed, however, with liberty to the petitioner to approach this Court again, if occasion so arises.
Also heard Mr. Z. Kamar, learned Senior counsel for the objector and Ms. P. Das, learned standing counsel, NCB.
