This application under Section 439 Cr.PC, has been filed praying for bail of the petitioner, namely, Md. Gulzar Hussain, who is in detention in connection with Tezpur PS Case No. 2491/2019 under Section 420/406 IPC.

Heard Mr. M. Rahman, learned counsel for the petitioner and Ms. A. Begum, learned Addl. P.P. for the respondent.

As per the allegation made in the FIR, on the basis of secret information, the police arrested the petitioner and a replica of boat made of golden material was

recovered from him.

Perused the case diary produced today.

Having considered the accusation and materials in the case diary as well as the length of detention, further custodial detention of the petitioner is not considered necessary. Accordingly, the petitioner is allowed to be enlarged on bail of Rs. 20,000/with one suitable surety of the like amount to the satisfaction of the learned CJM, Sonitpur, Tezpur, subject, of course, to the following conditions:

The accused petitioner shall co-operate in the investigation as and when required;

The accused petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts either to the Court or to any police officer.

The accused petitioner shall not commit any similar offence, of which he is accused or suspected commission.

Bail application is disposed of.
