This application under Section 439 Cr.PC, has been filed praying for bail of the petitioner, Anam Uddin Laskar, who is in detention in connection with Silchar P.S. Case No. 2186/2019 under Section 342/376/343/506/325/34 IPC R/W 6 of POCSO Act.

Heard Mr. A.M. Bora, learned Sr. Counsel and Mr. P.P. Baruah, learned P.P. for the respondent.

The petitioner has been in custody since 21.10.2019.

The allegation against the petitioner was that the victim was taken away and she was subjected to sexual assault.

It is submitted by the learned counsel for the petitioner that the petitioner and the victim were already married.

Having considered the nature of accusation and the length of detention, further custodial detention of the petitioner is not considered necessary in the interest of investigation. Accordingly, the petitioner is allowed to be enlarged on bail of Rs. 20,000/- with one suitable surety of the like amount to the satisfaction of the learned CJM, Cachar, subject, of course, to the following conditions:

The accused petitioner shall co-operate in the investigation as and when required;

The accused petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts either to the Court or to any police officer.

The accused petitioner shall not commit any similar offence, of which they are accused or suspected commission.

Bail application is disposed of.
