The case diary has been duly perused. Statements of the complainant and the other witnesses are noted. One of the witnesses, Sri Jubin Mech in his statements categorically mentioned the name of the petitioner along with some other persons to be associated who had accompanied the said witness to the Nursing Home of the informant to make enquiries in respect of some allegations that they were informed about. The said witness claimed to be a member of “Lachit Sena”. Accused, Md. Mohsin Rahman in his statements mentioned amongst others the name of the petitioner as persons with whom he had shared through whatsapp messages various irregularities they were going on in the Nursing Home. In pursuance to the messages shared, the accused Mohsin Rahman had met with these persons in front of Hotel Vandana in the Dibrugarh Town. There he stated to have apprised the group on various modes by which money can be demanded from the Nursing Home. He stated that subsequently, he was informed that these persons (including the petitioner) had proceeded to the Damani’s Nursing Home and demanded money. There is also another witness, Sri Mridu Paban Duarah, who stated before the police that on 12.08.2020 while he was returning back from the Assam Medical College Hospital after a medical checkup, in front of Damani’s Nursing Home, he found several persons including his brother, Sanjib Duarah along with other persons including the petitioner. Subsequently, he came to be informed that these persons had demanded and taken away about Rs.90,000/- (Rupees ninety thousand) only from the said Nursing Home.
