obtained from the public sector banks which is under progress. Moreover, the petitioners have an appellate remedy before the DRT, Guwahati but such alternative remedy has not been availed by them. Under the circumstances, this Court is not inclined to entertain this writ petition on merits. However, taking note of the stand of the petitioners’ counsel that his clients are ready and willing to repay the entire outstanding dues in a time bound manner and considering the submission made by Mr. Hussain that the possession of the house will be taken over on 09.12.2019, for the ends of justice, this writ petition is being disposed of by granting 15 days time to the petitioners to approach the bank with an application for rephasement of the repayment of installment and/or extending the benefits of OTS scheme, if any, permissible in this case. If such an application is filed within 15 days from today, accompanied by a Bank Draft of Rs.3.5 Lakhs payable to the respondent No.1, then in that event, the prayer of the petitioner may be considered by the Bank in accordance with law and be disposed of by a speaking order. Until such time, status quo as regards the property in question shall be maintained.
