That the answering deponent begs to state that both writ petitioner and private respondent No.6 appeared in interview against Japangbari AWC pursuant to advertisement dtd 8/9/2009 and the private respondent No.6 did well in the interview securing 29.4 marks in the interview whereas the petitioner got less marks i.e. 27 marks in the interview which is evident from the Comparative Statement of interview. It is pertinent to mention herein that the application form of the writ petitioner contained the residential status certificate dated 14/9/2009 issued by the Gaonbura, residential certificate dtd 16/9/2009 issued from the office of the Rajapara GP reflects that the writ petitioner is a resident of khukhapara, P.O. Borduar, Mouza- Borduar, under Palash Bari revenue circle, Dist- Kamrup and the application form of the private respondent also contained residential certificate dtd 30/12/2008 issued by Gaonbura reflects that the private respondent No.6 is resident of Village Moirapur, P.O. Borduar, Mouza- Borduar under Palashbari revenue circle but both the aforesaid residential certificates does not reflect that both of them are residing with the AWC area in question i.e. Japangbari AWC and as per advertisement, one of the condition is that the applicant should reside within the AWC area. Deponent craves leave of the Hon’ble Court to produce the aforesaid comparative statement, advertisement dtd 8/9/2009 and the aforesaid residential certificates at the time of hearing of the case.”
