the Exhibit-D Kabin-nama. Apparently, the Exhibit-C Certificate did not stand proved through the legal testimony of the issuing authority. Thus, the same rendered itself as inadmissible in evidence and without any evidentiary value. In so far as Exhibit-D Kabin-nama is concerned, the aforesaid DW-3 deposed in his capacity as the son of the Kazi who had performed the marriage between the petitioner and one Mohammad Sohrab Ali of village Sonahara, district Goalpara. A mere perusal of the evidence so tendered by DW-3, it is seen that he himself admitted that he is not a registered Kazi and the marriage was performed by his father on 22.12.2001. Surprising to note that without being a registered Kazi he had in his possession the original Register at Volume No.3 and was the signatory to the Kabin-nama which was obtained by the petitioner in the year 2016. As regards the deposition of Hafizullah Sheikh as DW-2, it is seen that he makes statement that the petitioner is his younger sister but is unable to say when she got married. No proof of relationship with Johar Uddin, whom the DW-2 claims to be his father, was produced. In fact, the very endeavour to establish that DW-2 is the elder brother of the petitioner and that both of them are children of Johar Uddin, utterly failed. Importantly, neither in the written statement nor in the evidence-on-affidavit, the petitioner had mentioned the names of her siblings, including DW-2.
