The facts leading to filing of the present appeal may be stated as follows: The appellants/petitioners are the legal heirs of late Mokram Ali, who was the absolute owner with respect to the land covered by the Dag Nos. 85 and 87 of KP Patta No. 295 of village Santoshpur Part III, Srijangram Revenue Circle in the district of Bongaigaon. Late Mokram Ali died leaving behind his three sons, namely, Mokbul Hussain, Kaddus Ali and Sheikh Amzad Hussain and five daughters, namely, Halimon Nessa, Haziron Nessa, Aymona Nessa, Khudiza Begam and Salimon Nessa. Out of the said legal heirs, Mokbul Hussain and Kaddus Ali had died and their legal heirs are appellants/petitioners No. 2 to 8. On the other hand, out of the five daughters, Halimona Nessa, Haziron Nessa and Khudiza Begum had died. After the death of late Mokram Ali, the aforesaid land covered by the KP Patta No. 295 stood in the name of the three sons. On initiation of LA Case No. 05/2011-12 for acquisition of land for widening the National Highway, an amount of Rs.16,66,132/-(Rupees Sixteen lakhs sixty six thousand one hundred thirty two only) was assessed against the acquisition of land measuring 3B 1K 18L out of the said Dag Nos. 85 and 87 of the KP Patta No. 295. The compensation determined includes the compensation both for the land and Zirats standing thereon including dwelling houses of the said three sons.
