This petition is filed by the petitioner seeking transfer of the said proceeding from the Court of learned District Judge, Jorhat at Jorhat to the Court of learned District Judge, Sonitpur at Tezpur, inter-alia, on the ground that the petitioner has no means to attend the proceeding at Jorhat. If she is made to attend the same, she will suffer immense inconvenience as there is nobody in her family to accompany her from her place of residence, Besseria, Tezpur to Jorhat. It is further submitted that the petitioner’s family consists of her father, mother, a younger brother, a student of Class – VII and a younger sister, a student of Class – XII. Her father is a Havilder by occupation but since sometime, he has been suffering from severe nerve problems which has caused severe physical infirmity. Therefore, he too is not in a position to accompany the petitioner to attend the proceedings at Jorhat. Apart from him, there is no one else in her family to accompany her to Jorhat. The main reason, according to the petitioner, for her not staying in the matrimonial home of the respondent at Jorhat is that the respondent had earlier entered into marriage with another lady and they had resided together as husband and wife for more than 1½ years at Jorhat and the said fact was suppressed by the respondent at the time of his marriage with the petitioner. That apart, the petitioner is pursuing Law course at Tezpur Law College at present. Moreover, the entire family consisting of 5 (five) members including herself, is surviving on the meager salary income of her father.
