It is submitted by the learned counsel for the petitioner that the petitioner is an accused in the aforementioned complaint case. As the petitioner is staying at Arunachal Pradesh in connection with his work, he could not appear personally and the learned counsel has been taking steps on behalf of the accused petitioner. However, on 04-07-2018 when the learned counsel for the petitioner again filed an application seeking adjournment on behalf of the petitioner, learned Magistrate rejected the application and issued non-bailable warrant of arrest against him. It is contended by the learned counsel for the petitioner that absence of the petitioner on 04-07-2018 was not intentional, inasmuch as, he was outside the State and therefore, he could not appear and the steps on his behalf was taken by his counsel. It is also submitted, that the petitioner has now come back and is ready and willing to appear before the learned trial court, and as such, prayed for recalling the warrant of arrest.
